- The Supreme Court has no jurisdiction to hear the case.
- The petitioners have no legal standing to sue.
- The petitioners have not shown injury to their person.
- There is no law prohibiting the construction of Torre de Manila.
Those who voted to dismiss the petition are Chief Justice Sereno ad Justices Carpio, Velasco, Bersamin, Del Castillo, Reyes, Bernabe, Leonen, and Tijam. Those who dissented are Justices De Castro, Peralta, Mendoza, Jardeleza, Caguioa and Martires.
